Chinese Law, Can I get kicked out?

If my company refuses to pay me my salary for the month I worked, what can I do?

Can I stay in my apartment until they pay me my salary (they rent the apartment)? What can I do? Will I get thrown out?

If you have a contract stipulating all you're entitled to, then they are bound to honor it.

However, unless you have some lawyer friends to help you, you probably won't win in the long run.

However, you need to understand that in China, the only legally binding contract is the government contract that you sign accompanying your school's individual contract. ( the smaller sized little brown booklet that has english in the front and chinese in the back ) In there, it states what the school must adhere to.

You can try to stay in your apartment, but don't depend on your utilities functioning. They can actually evict you, but like someone already said, you have a side of the case as well - they haven't paid you.

If they haven't paid you, I would suggest
a) stop working until they do pay you
b) enlist help and support from any other foreign teachers they may have
c) contact your embassy, which can be very helpfull and ask them what you can do, and what they can do to you.
d) finally, I would suggest contacting the local PSB, as they handle visas and all foreign affairs ( but be sure that you have a valid working visa and green card before you approach them ) explain to them that you have not been paid and your contract stipulations have not been met. If you keep bugging them, they will do something about it.
